These terms and this privacy notice apply to both of my websites, emilygardnerocd.com and emilygardner.co.uk. Part 1 explains the basis on which you use my websites. Part 2 explains how I collect, use, and protect your personal information — from the first time you come across my work or get in touch, through to working with me in my coaching programme. I want you to feel confident that your information, especially anything about your mental health, is handled carefully and kept confidential.
PART 1 — TERMS OF USE
Using this website
I share the information and materials on my websites in good faith and keep them as accurate and up to date as I can, but they are provided for general information only. They are not a substitute for professional, medical, or psychological advice, and I don't guarantee they are complete, accurate, or suitable for your particular circumstances. Any action you take based on this content is at your own discretion.
Limitation of liability
As far as the law allows, I am not liable for any loss or damage arising from your use of, or inability to use, my websites, or from relying on their content.
Intellectual property
All content on my websites — including text, images, and materials — belongs to Emily Gardner Unipessoal LDA and may not be copied, reproduced, or reused without my written permission.
Links to other websites
My websites may link to other sites I don't control. I'm not responsible for their content or their privacy practices, so please review their own policies when you visit them.
Governing law
These terms are governed by the law of Portugal. If you are a consumer resident in another country, you keep the protection of the mandatory consumer laws of the country where you live.
PART 2 — PRIVACY NOTICE
1. Who I am
Emily Gardner Unipessoal LDA ("I", "me", "my") is the data controller responsible for your personal information. If you have any questions about this notice or your data, you can contact me at emily@emilygardnerocd.com.
2. The information I collect
Depending on how far you go in the process, I may collect:
- When you respond to an advert or visit my landing page: your name and email address, plus technical information (such as cookie and pixel data) collected through Meta.
- When you fill in a contact form on either of my websites (emilygardnerocd.com or emilygardner.co.uk): your name, email, and whatever you include in your message.
- When you register for my on-demand webinar: your name and email, and information about your registration and viewing.
- When you book a call or complete an application form: your answers to the application questions, your phone number, and your name and email again.
- On our initial assessment call: brief notes from our conversation and whether working together is a good fit for you.
- If you join the programme: your payment details (handled by Stripe) and the participation records described in your Participation Agreement.
3. Information about your OCD and mental health
Some of the information you share — particularly in your application and during the programme — relates to your mental health. Data protection law treats this as "special category" information and gives it extra protection. I only collect it where it is relevant to supporting you, and I rely on your explicit consent, which you give when you submit your application and when you join the programme. You can withdraw that consent at any time by contacting me, though this may mean I won't be able to provide services to you.
4. Why I use your information and my lawful basis
- To respond to your enquiry and provide information about the programme — because it is in our mutual interest and part of taking steps towards a possible agreement.
- To send you marketing emails about my work — based on your consent, which you can withdraw at any time using the unsubscribe link.
- To deliver the programme once you join — to fulfil our agreement.
- To handle information about your mental health — based on your explicit consent.
- To keep records for professional, insurance, and legal reasons — to meet my legal obligations and protect my legitimate interests.
5. The services I use and who I share your information with
To run my business I use a number of trusted services, and your information may pass through them:
- Ontraport — my CRM, landing pages, email, and webinar hosting.
- Zoom — video calls.
- Stripe — processing your payment.
- Skool — hosting the community and delivering the programme.
- Meta (Facebook and Instagram) — advertising.
I only share your information with others where it is absolutely necessary — for example, with my legal advisers if a complaint or dispute arose — or where the law requires it.
Some of these services (including Meta, Ontraport, and Skool) are based in the United States, so your information may be transferred outside the EU/EEA. Where that happens, it is protected by appropriate legal safeguards such as Standard Contractual Clauses.
6. How long I keep your information
- General enquiries, including website contact forms: kept only as long as I need to deal with your enquiry, and no longer than 12 months unless you go on to join.
- Marketing contact (your name and email): kept while you remain subscribed to my emails, and removed when you unsubscribe or during a routine clean-up of inactive contacts.
- Any information about your OCD or mental health, if you don't work with me/join my programme: deleted within 12 months.
- If you work with me/join my programme: up to six years after the programme ends, in line with your Participation Agreement, unless the law requires longer.
7. Cookies
My websites use cookies and similar technologies — small files stored on your device — to help the sites work, to understand how they are used, and to measure and deliver advertising (including through the Meta pixel). You can control or turn off cookies in your browser settings, though some parts of the site may not work properly if you do. Where required, I will ask for your consent to non-essential cookies when you first visit.
8. Your rights
You have the right to ask me to: give you a copy of your data; correct it; delete it; restrict or object to how I use it; and receive it in a portable format. You can also withdraw any consent you have given. To exercise any of these, just email me at emily@emilygardnerocd.com.
If you are unhappy with how I have handled your data, you can complain to the Portuguese data protection authority, the Comissão Nacional de Proteção de Dados (CNPD) — www.cnpd.pt.
9. Changes to this notice
I may update these terms and this notice from time to time. The latest version will always be available on my websites, with the date it was last updated shown at the top.
